The (noun)の上では is used to express "according to (noun)" or "from the perspective of (noun)".
This pattern is very similar to 「(noun)上」, but is mainly used to express "according to X", and can be used with a wider variety of nouns.
では emphasizes the following phrase, giving us two common patterns of use:
① (noun)の上では ...... が・けど、......。
② (noun)の上では ......。
Pattern ① uses は's emphatic powers to set up a contrastive statement between "according to (noun)" and a given reality, while pattern ② simply emphasizes that "according to/based on/from X perspective... X is the case".
E.g. この書類の上では5月15日生まれとなっていますが、本当は5月13日なんです。 "According to these documents, (their) date of birth is May 15th, but it's actually May 13th."
E.g. 人間の歴史は、長い地球の歴史の上ではほんの一部にすぎません。 "From the perspective of the long history of the Earth, human history is but one small part."
E.g. 健康診断の結果の上では問題がなかったが、どうも調子が良くない。 "I don't have any issues according to my health check-up, but I somehow just don't feel good."
